New Jersey's attorney general filed a petition for certiorari on September 2, 2026, asking the Court to decide whether federal commodities law shields Kalshi's sports-outcome contracts from state gambling law after two appeals courts answered that question differently.
A unanimous appeals panel ruled on August 28, 2026 that federal commodities law does not shield Kalshi's sports-outcome contracts from Nevada's gaming law, the opposite of what a different appeals court decided for New Jersey four months earlier.
